Ren Hayhurst’s practice focuses on all aspects of structured finance transactions, including real estate and commercial loan documentation, real estate loan workouts and foreclosure, receivership and loan/guaranty enforcement litigation. Mr. Hayhurst has created widely used forms for standard and revolving line of credit loans for the acquisition, development and construction of regional shopping centers, retail power centers, alternative energy power facilities, single family and multi-family residential housing projects, affordable housing projects, and industrial buildings and warehouses. He has documented and closed finance transactions involving real property and other collateral in every State in the country. He also has developed commonly used forms for multi-jurisdiction real estate syndication/participation transactions and REMIC conduit loan packages,including secured and unsecured loan facilities, tax exempt bond financings, portfolio acquisitions, complex debt restructurings (both within and outside bankruptcy) and letter of credit facilities.
Mr. Hayhurst also has developed with support from Bryan Cave a proprietary documentation automation program which allows banks to generate complex transactional documents for multifamily and commercial real estate loan transactions in multiple States.
In addition, he was a trial attorney for the first ten years of his professional life and has represented lenders and borrowers the enforcement of secured and unsecured loan transactions. In this regard, he has tried numerous bench and jury trials, has argued cases before the Arizona and California Courts of Appeals and has appeared in cases before the Arizona and California Supreme Courts. He is a frequent speaker at seminars, and has developed a number of CLE and inhouse client workshops, covering a wide variety of real estate and structured finance topics, both for real estate attorneys and for non-legal professionals in this area.
